getting photos off of disconnected phone?

I need some evidence. I am trying to get out of Spousal sprt - she cheated,
left me - end of story. My daughter was given her old picture phone and she
showed me a photo of the homewrecker and her sitting on a couch with my 2 yr
old in the middle - like it was their kid or something. I got to thinking
that a photo is a 1000 words and to a judge it might make a big influence on
if he were to allow her to seek atty's fees and SSuprt. Its a long shot I
know - but the photo to me was disturbing. If we share the children 50/50 I
think it would say to a judge that this women has left one man for another,
selfishly rushed another in and into the children's lives and tried to stick
the dumped husband with a big bill.

So if it carries some weight how do I get it off off a cell phone with
disconnected service???
