Samsung sgh-c417 phones

| My father and I upgraded our phones in January. We went from a Motorola
to the Samsung sgh-c417 flip phone. Never had any problems with the
Motorola phones. These Samsungs are a different thing.
Within the first 3 weeks of having the new phones, the little outside
screen on my father's cracked. It had not been dropped nor exposed to
any extreme temps. We called Cingular and they said "Sorry, the
Warranty does not cover damage from being dropped or exposure to extreme
temps." "No we will not replace the phone".
A month and a half ago, my phone's inside screen cracked and part of
the screen turned black. I had not dropped it nor had I exposed it to
anything. I pulled it out of my pocket to answer it and I could not
read part of the message on it. I called Cingular. They told me that
they would send me a reconditioned phone to replace it but if it had any
physical damage that I would have to pay $65.00 even if it was that
their parts were defective from the factory. I recieved the "new" phone
in the mail. It had no packing around it to protect it. Anyway, it
worked and its screens were intact. I mailed the old one back.
Yesterday, I recieved a package from Cingular. It was my old phone.
It said that it had been dropped and that it had water damamge and they
were not covering it under warranty and they were billing me $65.00.
WATER DAMAGE???!!! it had not even been in the rain nor ever dropped.
My old Motorola had been dropped numerous times and it never had any
problems..
Is that fair?
I have talked to a couple of other people with the same phones and they
said the same happened to them soon after getting the phone. One said
that the only thing that he knew that could have broken his screen was
that he was trying to flip it open to answer it and kinda squeezed the
screen between his fingers. The other said that she had no idea.
Anyone else have any similar experiences?

Many phones have a tiny sticker under the battery that turns color if
it ever gets wet. Apparently yours had.

| I feel your pain, but you should know that you tend to get what you pay
for, and that cheap phones are, well, cheap. More durable phones cost
more. You may also want to consider insurance.

Those stickers are highly imperfect. They can change color if just
accidentally touched by a moist finger, or in high humidity
environments. Don't take it lying down if you know your device hasn't
actually been subjected to damaging moisture.

packing label said. They said that it had been dropped or gnawed on
etc. When I told them that I have never dropped it the Cingular lady
said that was what their research shows. I then told her about what it
said on the papers with the phone, that it had water damage. She said
"I don't know sir, what the computer says is all I know." Then I told
her that I have insurance and she said "the insurance does not cover
physical damage." Then I asked her what if the parts were junk when
they were put in. And she replied, "you would have to prove it sir".
So know what? Oh, by the way, to replace the phone, it would cost
$265.00. That don't sound like a cheap phone to me.

The legal burden of proof is actually on the insurance carrier, not you.
Start by filing a complaint with the Better Business Bureau, and
contacting the Cingular "Office of the President" (as suggested in the
Cingular FAQ below).

As a suggested retail price that actually is pretty cheap. You could
probably find it for less from a retail dealer (or on eBay).
