More and more companies are collecting the tax since you are liable. Save
you the trouble of sending it in to the state as "use tax" later. Some
states have been going after the large retailers and putting pressure on
them to collect the tax.

I'd certainly bet they are sending it to the state. Companies are audited
and it is far easier to pass along the legitimate tax than to try to bury it
in the books. Enron type dealings are in the tiny minority.
