Have a mobile Motorola E1000 from e2save on 3 network monthly contract.

Just back after having been set away for repair five times but I daren't
open the parcel in case it is faulty still.

Tried e2save who referred me to Motorola who referred me to the 3 network.
It has been the 3 network who have arranged collection and
repair/replacement each of the five times.

What about the total time spent on the phone five x average of 20 minutes,
what about having to use a phone box, what about having to buy a top up card
for my old PAYG which I found in the bottom of my drawer.

I despair and need advice who is responsible and the best way of complaining
should the phone be faulty again.

send a letter of intent to the people you paid the money to - e2save

clearly and calmly lay out, in chronological order, exactly what has gone
wrong, who promised to fix it, what's still wrong and that you'd like a full
refund as the good is clearly not fit for purpose.

politely give them the oppourtunity to respond within 14 days and gently
tell them that if they don't you will issue proceedings through the courts.

meanwhile, get yourself down to your local county court/small claims
court and as the very helpful people there precisely how to initiate a
claim. then scoot by your local CAB or TS office for further advice.

The retailer is responsible as per the sale of goods act.

After two repairs they said they would replace it. They carefully used the
word replace so I guess it was another but refurbed.
